Release of Liability, Waiver of Claims, Assumption of Risk, Covenant Not to Sue and Hold Harmless Agreement

What you are about to read and are requested to sign is a waiver and release of liability. Upon electronically signing it, you will give up the right to sue the owners and operators of The Fuste, LLC and anyone associated with The Fuste, LLC such as its agents, owners, shareholders, directors, partners, employees, volunteers, manufacturers, participants, lessors, affiliates, its subsidiaries, related and affiliated entities, successors and assigns (the "Released Parties) for injuries or losses you suffer (up to and including loss of life or limb) while participating in a Winterfüste, Sprûngenfüste, Sömmer Kamp, Oktoberfüste or any general Füste competition or event and all associated activities. Please take your time and read this agreement very carefully. When you are certain that you understand and agree to each section, please check the associated box. General

I understand that electronically signing this document will prevent me, my heirs, executors, dependents, beneficiaries, and assigns from suing The Fuste, LLC, its owners and operators, officers, directors, members, employees, agents and guests (to specifically include Mr. Sean Rogoff) for any injuries, including death and paralysis, any resulting medical conditions or events, including heart attack, stroke, and the like, or damages that I might receive while participating in any activities associated with The Fuste LLC, "Füsting", Winterfüste, Sömmerfüste, Oktoberfüste, or Füste related competition or events in general.

Schmerzenfüste (Exercise)

I understand that all activities associated with The Fuste, LLC competitions or events ("Füsting"), which are unsupervised, can involve strenuous physical exertion and may require sound judgement during my participation. I understand that by participating in any Füste LLC related event I am at risk to suffer serious physical injury and possibly death. I understand and agree that I alone am responsible to determine my physical and mental fitness and my suitability to participate. I acknowledge that I will not hold The Fuste, LLC or any associated agent of The Fuste, LLC liable for any injury (up to and including death of my person) I incur while participating in the competition or event.

Foodenfüste/Drunkenfüste (Diet)

I recognize and understand the risks of nutritional changes associated with participating in The Fuste, LLC competition and am participating in Winterfüste '25 activities upon the express agreement and understanding that I do hereby for myself and my heirs, executors, and administrators waive and release the owners and operators of The Fuste, LLC from any and all claims, costs, liability, expenses or judgements including attorney's fees and court costs arising out of my participation in The Fuste, LLC competition or any illness or injury resulting there from and hereby agree to indemnify and hold harmless the owners and operators of The Fuste, LLC from and against any and all such claims.
